The Delhi High Court on Monday dismissed a batch of petitions seeking independent probes into the 2020 North East Delhi violence and the 2019 police violence at Jamia Millia Islamia, including pleas seeking FIRs against Hindutva political leaders such as Anurag Thakur over hate speeches and action against police officials.
A division bench comprising Justice Vivek Chaudhary and Justice Manoj Jain also rejected pleas seeking the registration of FIRs against political leaders over alleged hate speeches and action against police officials accused of dereliction of duty, Live Law reported.
“For the reasons mentioned in the judgments, both the petitions (batch) are dismissed,” the court said while pronouncing the verdict.
The petitions, filed in 2020, sought an independent Special Investigation Team (SIT) probe into the riots, FIRs against political leaders over alleged hate speeches, and action against police officials accused of misconduct during the violence.
One of the petitions was filed by Shaikh Mujtaba Farooq, seeking FIRs against BJP leaders Kapil Mishra, Anurag Thakur, Parvesh Verma and Abhay Verma over hate speeches that, according to the plea, incited the anti-Muslim violence. It also sought action against police personnel accused of dereliction of duty.
Another petition, filed by Lawyers Voice, a Hindutva-affiliated platform, sought action over speeches by Congress leaders Sonia Gandhi, Rahul Gandhi and Priyanka Gandhi Vadra, former Delhi deputy chief minister Manish Sisodia, AAP MLA Amanatullah Khan, AIMIM leader Akbaruddin Owaisi, former AIMIM MLA Waris Pathan and several others.
A plea filed by former CPI(M) leader Brinda Karat sought an independent investigation into complaints alleging offences and atrocities committed by members of the Delhi Police, Rapid Action Force and other state functionaries during the riots.
