
The Allahabad High Court directed the Uttar Pradesh government not to demolish the building of Azad Jannat Nisha School, a long-standing educational institution in Alam Sarai, Sambhal, after the legal heirs of those who had sold the land 46 years ago, along with local Hindutva groups, claimed ownership of the property.
The petition was filed by Mohammad Shahvez Alam, Manager of Azad Jannat Nisha School in Alam Sarai, Sambhal, asserting that he has been the rightful owner and occupant of the land since 1979.
A bench comprising Justice Siddhartha Varma and Justice Harvir Singh issued an order directing the state not to demolish the school building and also directed the respondents not to interfere in the “peaceful possession and functioning of the institution.”
The issue began on January 13, 2025, when the District Magistrate, Sub-Divisional Magistrate, a group of policemen, and local officials, including the Tahsildar, Lekhpal, and Nayab Lekhpal, arrived at the school premises along with a large group of men claiming ownership of the land, and proceeded to threaten the owners.
The school manager claimed that his father had purchased the land from Nathua alias Ganga Prasad and Har Prasad through a registered sale deed dated January 8, 1979, but now their legal heirs are asserting ownership of the property.
