A Delhi court has directed the police to register an FIR against several individuals based on a Muslim man’s complaint alleging that he and his family were targeted during the 2020 North-East Delhi pogrom by a mob that used hate speech, raised provocative slogans, and looted their home, observing that the police failed to act upon the complaint, LiveLaw reported.
Judicial Magistrate First Class Isra Zaidi of Karkardooma Courts observed that the complaint filed by Rahees Ahmed “disclosed commission of grave and cognizable offences,” noting that “the complainant has made serious allegations of communal violence, looting, arson, hate speech naming specific individuals with detailed roles.”
“In such circumstances, the complainant cannot be compelled to seek redressal through a general or unrelated FIR that does not capture his distinct allegations,” the Court said, adding, “such grave allegations cannot be permitted to be diluted or ignored merely by clubbing with a general FIR.”
The judge was hearing the plea of Rahees Ahmed, who alleged that during the 2020 North-East Delhi pogrom, he and his family were subjected to a targeted and violent attack by a mob armed with weapons, including lathis, iron rods, and petrol bombs.
The complaint alleged that the targeted and violent attack was carried out by a mob comprising Vinod, Tinku, Aadesh Sharma, Mahesh, Suresh, Monu, Anshu Pandit, Rajpal, and others, pelted stones at him, used firearms, vandalized and looted his house, stealing valuables including jewellery and cash, and also set fire to a tent house, destroying the property.
The complaint also alleged that the mob raised provocative communal slogans and used hate speech with the intent to incite violence and instil fear.
He said his house was vandalised, valuables, including jewellery and cash, were stolen, and he was attacked with stones.
According to the complaint, the mob not only pelted stones at the complainant but also used firearms and issued threats to life.
One individual, Aadesh Sharma, is said to have held a gun and shouted “Mulle tujhe aur tere pure khandan ko aaj katal karna hai, tumhe yahan rehne ka koi hak nahi pakistaniyo” (“You Muslim, today I will kill you and your entire family, you Pakistanis have no right to live here”).
