The Karnataka High Court on Tuesday advised the RSS leader Dr. Kalladka Prabhakar to refrain from making “venomous” speeches and exercise restraint in future public remarks while hearing his plea to quash an FIR accusing him of spreading communal enmity through comments about Muslim women and birth rates, Live Law reported.
The matter came up before Justice M. Nagaprasanna, who was informed by the complainant, Ishwari Padmunja of the Karnataka State Dalita Hakkugala Rajya Samiti, that Kalladka had repeatedly made inflammatory remarks targeting Muslims.
Seeking restrictions on his future speeches, the complainant alleged that the activist routinely used public platforms to spread communal hatred.
Responding to the submissions, the court orally remarked, “Without venom, you speak… Why give rise to complaints after complaints?However, the matter we will answer legally.”
According to the complaint, Kalladka compared birth rates among Muslims and Hindus, expressed concern over the declining Hindu population in certain constituencies, including Ullal, and urged Hindus to have at least three children in every household.
He allegedly linked the call to increasing the Hindu population for “Lord Mahalingeshwara.”
The complainant alleged that the remarks insulted the dignity of women from both communities, promoted religious enmity and disturbed public peace.
Based on the complaint, the Puttur Rural Police registered a case against Kalladka under Sections 3(5), 79, 196, 299 and 302 of the Bharatiya Nyaya Sanhita, 2023.
The High Court tagged the matter with connected petitions and posted it for hearing on June 16.
When the complainant sought an interim direction restraining Kalladka from making similar speeches, the court noted that he had already undertaken not to repeat such remarks.
