
The All India Lawyers’ Association for Justice (AILAJ) raised alarm over the Supreme Court’s decision not to initiate an in-house inquiry against Allahabad High Court Justice Shekhar Kumar Yadav, despite his controversial remarks promoting a Hindu majoritarian perspective during a December 2024 lecture organised by the Vishva Hindu Parishad.
The All India Lawyers’ Association for Justice (AILAJ) said Friday that the judiciary’s credibility is at risk after reports indicated the Supreme Court halted its plan to investigate Justice Yadav following a communication from the Rajya Sabha Secretariat claiming exclusive jurisdiction in the matter.
“Bigotry is the antithesis of fraternity, and the judiciary must not tolerate it within its ranks,” AILAJ statement reads.
Justice Yadav, who had spoken on the “Constitutional Necessity of Uniform Civil Code” at the event held on court premises, was accused of making Islamophobic statements. The Supreme Court collegium reportedly advised him to apologise, but he refused, receiving political backing from Uttar Pradesh Chief Minister Yogi Adityanath and others.
AILAJ criticised Rajya Sabha Chairman Jagdeep Dhankhar for not admitting the impeachment motion filed on December 13, 2024, and accused Parliament of shielding the judge. The group argued that the in-house judicial inquiry process is distinct from impeachment and should have proceeded independently.
“This is not merely a question of delay, but an act of shielding Justice Shekhar Kumar Yadav,” the association said in a statement, adding that inaction could embolden other judges with divisive mindsets to act similarly.
